What is the PACT Act? What to Know


The PACT Act stands for Prevent All Cigarette Trafficking and aims to minimize the risk of minors getting their hands on vaping products. The biggest impact of the bill is that the USPS is now prohibited from shipping vaping goods to customers’ homes. On top of that, vaping companies are now required to fill out very regulated paperwork regarding their sales in order to ensure that companies are not selling goods to underage users.


The PACT act so seemingly came out of nowhere that a good number of customers still do not even know exactly what it is, what it entails or what its effects will be moving forward. Therefore, here are five things that you need to know about it as a person who uses these types of products.

1: It Was Part of a Larger Spending Bill

The PACT Act was passed in December of 2020 as part of the big spending bill that included the COVID relief bill. Naturally, the COVID relief bill got more attention at the time, and the PACT Act was buried in the literature, which is why so many people didn’t even know about it until long after it was passed.

2: It Includes All Vaping Products

When the PACT Act was first passed, it seemed as though it only pertained to vaping goods that contain nicotine. But Congress amended the bill to include all vaping products, including those that are made with hemp and contain no nicotine or tobacco whatsoever. Therefore, the USPS is also prohibited from sending CBD, delta 8 and other hemp-derived vaping goods through the mail to customers.

3: Multiple Shipping Carriers Have Followed Suit

In response to the passing of this bill, both FedEx and UPS announced that they would also cease the shipment of vaping goods to the homes of customers around the same time that the USPS would discontinue these specific services. Therefore, currently, companies that sell vaping goods online cannot use any of these three shipping carriers to provide customers with their products.

4: It Does Not Affect Non-Vaping Products

It’s important to point out that the PACT Act does not include alternative delivery methods for hemp goods, such as flower, prerolls, cigarettes, tinctures, edibles and topicals. Therefore, if you prefer to consume delta 8 THC in the form of one of these products, you will be unaffected by this new bill. As of now, USPS, FedEx and UPS will continue to ship these products to customers as they are not classified in the same manner as tobacco products, as vaping goods now are.


Also, smokable delta 8 products remain protected from the PACT Act, which means that flower and pre-rolls are still available for shipment to your home via these three major shipping carriers.

5: It Does Not Disrupt Business-to-Business Transportation of Products

While these three big shipping carriers are no longer sending products directly to customers, they are still sending orders to other businesses. In other words, the vape shop in your neighborhood will still be fully stocked with the products that they have had on their shelves all long.

How Does the PACT Act Affect Delta 8 Customers?


As you can see, the PACT Act means that delta 8 THC vaping goods can no longer be sent through the mail to customers via USPS, FedEx, or UPS. It is possible that you’ve already found that you can’t order these products from your favorite retailer. More and more online retailers are making announcements pertaining to how this new bill affects their ability to conduct their business.


But it is important to point out that these three familiar shipping carriers are not the only ones that exist in the United States. Presently, companies are figuring out alternative means for getting their products into the hands of customers. There are other shipping carriers that, as of now, have not indicated that they intend to follow in the footsteps of USPS, FedEx, and UPS.


Because this new bill seemed to have taken place so quickly, online retailers did not have much time to set up accounts with alternative shipping carriers. The process of setting up a new account can take time, as there are important things that need to be established such as shipping costs, shipping time and regions to which the carriers will travel to transport products from a company’s warehouse to a customer’s door.


Therefore, as of now, the large majority of delta 8 suppliers are planning on resuming operations as soon as possible, and just need a short amount of time to work out contracts with these alternative suppliers. In other words, there is a very good chance that in the near future, customers will once again be able to easily order their favorite delta-8 products online and have them sent in a timely manner.

In the meantime, where can customers go to find quality, authentic delta 8? Here are the choices that customers have.

1: In Vape Shops, Smoke Shops, Head Shops, Tobacco Shops, C-Stores and Gas Stations

Like we said, the PACT Act does not affect business-to-business sales. These shipping carriers are still legally allowed to carry products from manufacturers to small businesses. What this means is that vape shops, which are the primary in-person resources for delta 8 goods, will continue to carry all types of delta 8 THC products just as they always have, with no interruption to their operations.

2: Online

You can still purchase the large majority of delta 8 THC products online and have them shipped via USPS, FedEx, or UPS. This includes pre-rolls and flower, which act similarly to vaping products in that they are inhaled as a highly bioavailable method for consuming delta 8.


The PACT Act Has Created an Obstacle for Many Vaping and Hemp Companies


However, the good news is that companies are already coming up with alternative ways to send vaping products to consumers.
